Ik kan in mijn woordenboeken geen vertaling vinden voor collateral warranty. Wel genoeg Engelstalige uitleg van het begrip (A collateral warranty is a contract which gives a third party rights collateral to rights in an existing contract entered into by two separate parties.
For instance, an architect is appointed to design a block of flats for a developer. That developer intends to sell the block of flats to a Housing association. Due to Privity of contract the architect would normally only be contractually liable to the client should defects arise. The collateral warranty establishes a contractual relationship between the Housing association and the architect against defect.) Helaas helpt mij dit niet om een goede Nederlandse term te vinden. Heeft iemand tips?

agree  Jack den Haan: Ben geen specialist op dit gebied, maar dit lijkt mij een goede vertaling. De gangbare vertalingen van 'collateral' gaan hier kennelijk gewooon niet op.

neutral  Koen Roelens: Dit suggereeert dat de aansprakelijkheid van de hoofdaannemer (met alle accessoires) overgedragen wordt. M.i. onstaat hier een nieuwe contractuele band tussen onderaannemer en opdrachtgever. Maar ik ken natuurlijk het document niet.
