Ik ken "punitive damages" alleen als shadevergoeding, maa dat past hier volgens mij niet helemaal.

privaatrechtelijke boete

Explanation:
Punitive damages is geen schadevergoeding maar een soort privaatrechtelijke boete (zie veel literatuur over aansprakelijkheidsrecht, bv. het preadvies van Bolt en Lensing 1993 voor de Nederlandse vereniging voor rechtsvergelijking, en ook Kamerstukken II, 1998-1999, 26 630, nr. 1).
De schrijver formuleert het een beetje vreemd, hij klutst de schade en de als vergoeding daarvoor toegewezen compensatie door elkaar. Het komt erop neer dat hij niks wenst te betalen, noch bij wijze van schadevergoeding voor alle mogelijke soorten schade, noch bij wijze van privaatrechtelijke boete mee die een rechter in een civiele zaak daarover mogelijk toewijst. Of dat kan is een tweede natuurlijk.
