In terms of causality, the prevailing view holds that recognition of an award may only be denied if the award is based on a procedural defect that can realistically be understood to have altered the resulting award.
As explained above, it can be realistically concluded that the composition of the arbitral tribunal being not conform to the agreement of the parties, the refusal of the arbitral tribunal to accept AAA's evidence on erroneous grounds and the delayed decision on the suspension request are procedural defects that have altered the resulting award.
