(b) Definitions…(D)riving means operating a commercial motor vehicle on a highway, including while temporarily stationary because of traffic, a traffic control device, or other momentary delays. Driving does not include operating a commercial motor vehicle when the driver has moved the vehicle to the side of, or off, a highway and has halted in a location where the vehicle can safely remain stationary.

disagree  Tony M: Here, it's not 'highway' in the US sense of 'autoroute', but just in the EN sense of a 'voie carrossable' (etc.) Autoroute or any other specific road type would be over-translation here.

Explanation:
Note this is the EN 'formal' sense of highway = public roadway, rather than the more restricted US sense of a fast main route.

In other words, it doesn't count as 'driving' if the vehicle is not actually on a public road. So if you have parked beside the road, or driven onto a private car park, you can't be charged with drunk driving (though you can still be charged with being drunk while in charge of a vehicle!) Warning: this is only a jocular passing remark, not a definitive statement of UK law!

agree  Tony M: Wouldn't one rather say 'garer'? And it isn't necessarily the bas-côté (= verge?), it's just off the actual road (lay-by, motorway hard shoulder, etc.) / OK, thanks for explaining!
