In the event of the Facility finally failing to meet the Guaranteed Performances regarding Facility net heat rate for fuel at 100% (one hundred per cent) load during Performance Test according to Article 8.3 above, Contractor shall pay for each per cent of increase in Facility net heat rate liquidated damages amounting to 0.25% (a quarter per cent) of the Contract Price but not exceeding a total of 5% (five per cent) of the Contract Price.

GDT :

The reciprocal of the heat rate expressed as a percentage is the thermal efficiency of the power station. In the case of the "heat rate" the units should be stated; in the case of the "thermal efficiency" the energy content of the fuel and the electrical energy produced must be expressed in the same unit.
