La loi établit le principe de la responsabilité objective ou responsabilité sans faute (responsabilité causale) du producteur en cas de dommage causé par un défaut de son produit. Le producteur doit donc répondre de tout défaut ou de toute carence de son produit, même s’il n’a commis aucune erreur.
