.. too late, but the following comment is in order: here notwithstanding the same... means: regardless of whether the same (= the works, not defects!!) were or were not inspected and/or accepted. So, 'nonobstant' is best & glos.entry needs to be corrected

Sorry, I should have explained a bit more. This document describes the terms and conditions of a contract for mooring connection and disconnection of a battle ship.
The sentence starts with :
The Contractor shall indemnify and hold harmless XXXin respect of any and all loss, damage or expense whether foreseeable or not suffered by XXin consequence of:
Any defect in, incorrect assembly or non compliance of the Work supplied or executed under or for the purpose of performing this Agreement ***notwithstanding the same*** may have been inspected and/or accepted by XXX

Please could you explain a bit more of the wider context; on the face of it, this doesn't make a great deal of sense, I have a feeling that the intended meaning is "...notwithstanding [the fact that the aformentioned] may have been inspected.."
