To answer the point made by Beila, the use of 'awarded' is not unheard of in things like Court judgements, where we do indeed say that 'costs were awarded to the plaintiff' etc.

agree  Beila Goldberg: encourus suffit ... La rédaction de ce contrat est très exotique : en général, awarded est utilisé en arbitrage. Ce que je voulais dire c'est que "awarded" n'est pas utilisé dans un contrat mais en arbitrage et certainement lors d'un jugement.
