It's a form guaranty containing a provision to pay:
"any and all costs, expenses and damages which may be paid or incurred in enforcing, or obtaining advice of counsel in respect of, any rights with respect to, or collecting, any or all the Guaranteed Obligations and/or enforcing any rights with repect to, or collecting against, the Gurantor under this guaranty."
Je sais que je demande bcp, mais c vraiment du charabia, en fait, je comprends jusqu'au premier "collecting" et apres rien ne va plus.
Si vous pouviez seulement m'expliquer le sens, ce serait deja 1 tres grand pas de franchi. Promis, derniere question de la soiree. Merci d'avance

C'est assez terrible, je suis d'accord. Comme je ne suis pas tres sure si je saurais bien toutes les expressions francaises, donc je vais essayez d'exprimer la meme chose d'une facon plus simple:

any and all costs, expenses and damages = tous les couts, dépense et préjudices(?) aussi bien que leur totalité (each cost/expense/damage + these altogether)
which may be paid or incurred = (couts, dépenses etc.) payés ou engagés
in enforcing, = (i.e. in enforcing any rights) en faisant valoir (les droits)
or obtaining advice of counsel = ou quand on utilise un conseil judiciaire
in respect of any rights with respect to = concernant les droits liés aux (obligations)
or collecting any or all the Guaranteed Obligations = or (concernant) une des obligations ou leur totalité
and/or
enforcing any rights with respect to, = en faisant valoir les droits liés (a cette garantie)
or collecting against, = ou (en faisant valoir les droits de) percevoir
the Guarantor under this guaranty." = (les paiements susmentionnés) de l'Avaliste selon cette garantie.

The short, every day version would be: all direct and indirect costs connected with the cash and non-cash costs etc., such as the administration of the whole issue + collection (e.g, bank) costs, including legal fees shall be borne by the Guarantor, according to this guarantee.

Non, c\'est trop compliqué, j\'essaie de nouveau:
- all costs/expenses/damages shall be borne by the Guarantor according to this guaranty
- whether these are actually paid or just \"incurred\" (= e.g. a foreign currency loss, unrealised profits or similar - these do not involve actual payments, but appear in the financial accounts) and
- if these are relating to the collection itself or legal advice about the collection
and/or
- if these are relating to steps taken in order to achieve the collection (such as the initiation of a process about this issue) or to realise the collection (forcing measures).
