The concept of trusteeship in land forms part of many Indigenous traditions. In this view, children are integral to the human-land relationship as they are meant to take on the role of trustee of their peoples’ lands and resources as they mature, and pass it on to the next generation. Land loss and degradation affect all aspects of Indigenous children’s health, development and survival; they are a major cause of poverty, conflict, instability and cultural breakdown."

Après avoir discuté avec le réviseur, nous avons opté pour ce terme (fiducie). Termium dit que le terme "fidéicommis" est à éviter comme traduction de "trust"...

Le trust dans ce sens est une institution inconnue du droit français mais pratiquée de manière illégale dans la France du XIXème et décrite par Balzac (notamment Ursule Mirouet) sous le terme de "fidéicommis" ou "fidéicommis occulte"

Lors d'une fiducie il y a un transfert absolu de proriété au fiduciaire pour qu'il le retransmette au fiduciant, alors que dans le trust et le fidéicommis, le trustee n'est jamais le propriétaire absolu du bien.
