Both parties are obliged to work together to resolve specific customer problems without undue delay.
If MMM should deem the technological prerequisites set by AWT-PPP unobtainable, MMM may, subject to agreement with PPP, refuse PPP’s order. With the prior agreement of MMM, and only in such exceptional case, PPP shall be free to carry out the project in question with another partner.
Payment of the test grinding wheels shall be made on the agreed payment terms and conditions, after the positive outcome of the tests and the approval of AWT. In exceptional cases, PPP and MMM may agree on derogations of this provision.
In case it proves impossible to achieve the technical parameters defined jointly as an objective, MMM and PPP shall decide together whether **to opt for a proportional percentage crediting**, or the restitution of the grinding wheels.
Everytime a test on a MMM grinding wheel is requested, or carried out, PPP is bound to advise MMM in writing of the means and time frame for the performance of that examination, leaving the latter to decide whether or not to have one of its technicians present at the testing. |
