Höhere Gewalt ist ein von außen kommendes außergewöhnliches Ereignis, das auch durch äußerste Sorgfalt des Betroffenen nicht verhindert werden kann (z.B. Brand, Unwetter, Streik). Wird ein Schaden durch höhere Gewalt verursacht, so kommt in den meisten Fällen eine Haftung nicht in Betracht. Für die Folgen der höheren Gewalt müssen allerdings der Schuldner im Verzug und der Dieb haften (vgl. §§ 287, 848 BGB).
