[X shall pay] liquidated damages [...] a sum calculated in accordance with the following formula:

Deficiency Years" means the time period in years (pro-rated) between the date of Facility Completion and the first to occur of (i) the date that a test demonstrates the Nominated Units meet the Power Curve Percentage Guarantee, or (ii) twenty four (24) months after the Facility Completion.

da es höchstens um die beiden ersten Jahre der Anlage geht und die "Mängel" nicht spezifiziert sind lediglich die fehlende Leistung (sei es aus Windmangel, sei es aus technischen Mängeln).
Ich bezweifle, ob ein Windmangel überhaupt ein Mangel im Sinne des bürgerlichen Rechts ist
