Unter den vier tatbestandserfüllenden Handlungsvarianten nimmt die Bevorzugung eine Sonderstellung ein. Bis zur Erlangung der Gleichheit mit der übrigen Bevölkerung ist sie im Rahmen der Besserstellung bestimmter, bislang benachteiligter Bevölkerungsgruppen – sogenannte positive Diskriminierung oder \"Affirmative action\" – zulässig. Unterscheidende, ausschließende, beschränkende oder bevorzugende Maßnahmen sind diskriminierend, wenn sie erstens auf den fünf genannten Unterscheidungskriterien beruhen und zweitens den gleichberechtigten Genuß der Menschenrechte und Grundfreiheiten in allen Bereichen des öffentlichen Lebens beeinträchtigen oder vereiteln beziehungsweise dies bezwecken. Mit diesem Artikel sollen alle Formen der Rassendiskriminierung erfaßt werden.

aktive Förderungsmaßnahme


Explanation:
Kim's Antwort zeigt schon in die richtige Richtung. Es gibt aber dafür auch einen speziellen Ausdruck: "aktive Förderungsmaßnahme" US. (ie, Wortlaut der Executive Order 11375 des US-Präsidenten vom 13.10.1967: "to ensure that applicants are employed ... and treated during employment, without regard to their race, color, religion, sex, or national origin" => bisher benachteiligte Bewerber müssen bei gleicher Qualifikation bevorzugt eingestellt und befördert werden)
