In vielen Staaten wird diese Anmeldung dann nach einer gewissen Zeit der Öffentlichkeit zugänglich gemacht (Auslegungsschrift [die Anmeldungen wurden tatsächlich in den Ämtern zur Ansicht ausgelegt], Offenlegungsschrift) Erst wenn das Patent nach Prüfung erteilt ist, gibt es die Patentschrift, wobei diese im Inhalt von der Anmeldung und/oder der Offenlegungsschrift in der Regel zumindest im Anspruchssatz abweicht. |

The only thing that can be "laid open" is an application (or, apparently, according to the 2nd ref. above, a translation). Otherwise it is a Patentschrift or similar. The discrepancy you mention may have to do with whether the document in question has already been examined or not (search the 2nd ref. also for "laid open" for further examples).
