Kontext: Fonds; Es besteht ein Treuhandvertrag zwischen der Verwaltungsgesellschaft und dem Treuhänder. Der Treuhänder tritt nun zurück und es wird per Stichtag 3. Februar ein neuer Treuhänder bestellt. Dazu gibt es einen Vertrag in dem alle drei Parteien: Verwaltungsgesellschaft, zurücktretender Treuhänder und der neue Treuhänder Vertragsparteien sind und wo unter anderem die Pflichten des zurücktretenden Treuhänders hinsichtlich des Transfers des Fondsvermögens an den neuen Treuhänder sowie die Pflicht der Verwaltungsgesellschaft und des zurücktretenden Treuhänders entsprechende Dokumente an den neuen Treuhänder zu übergeben aufgeführt sind, ebenso wie der Anspruch des zurücktretenden Treuhänders auf Entlohnung für seine Tätigkeit. Der Verkaufsprospekt ist dann entsprechend durch einen Nachtrag zu ändern.
