Ich habe mir die im Glossar bereits vorliegenden Begriffe angesehen, aber ganz glücklich werde ich damit nicht. Im konkreten Fall vielleicht am ehesten noch "Zwangsverwaltung". Was meint ihr? |

Schwierig ist das allemal. Jedenfalls kann es Konkurs-( richtiger: Insolvenz-) Verwaltung wohl nicht sein, wie die anderen Kollegen schon feststellten. Damit kann allenfalls sonst eine Art Fremdaufsicht durch z.B. einen Inspektor gemeint sein, wie es beispielsweise im niederländischen Recht möglich ist. Dan funktioniert die Fa. wie bisher, der Inspektor ist aber immer Mitentscheider. Z.B. in Fällen, in denen die beiden Gesellschafter im Streit sind und der Dritte als Entscheider her muss. |
