Hier ist nicht unbedingt eine formelle Klage gemeint. Wie die letzte der von mir unten gezeigten Sites zum Thema Anerkennung und Vollstreckung von ausländischen urteilen (hier: für den europäischen Raum) zeigt, ist diese Anerkennung und Ausführung/Vollstreckung von Urteilen europaweit geregelt. Ich meine eher, dass es hier nur um eine Anerkennung des ausändischn Urteils und seine Umsetzung bzw. Vollstreckung geht. Diese Interpretation legen auch sprachliche Belege aus dem amerikanischen Rechtsraum nahe. Hier hat "suit" eben eher die Bedeutung von "to follow suit" .

Sections 826-828 provide for the enforcement of foreign judgement in Malta by way of writ of summons. According to the dicta in Pace v. Camilleri (1903), it appears that in order to enforce a foreign judgement in Malta one must institute an action upon a writ of summons.

A state which may not constitutionally refuse to open its courts to a suit on a judgment of another state because of the nature of the cause of action merged in the judgment, Kenney v. Supreme Lodge, supra, 415, 40 S.Ct. 372, obviously cannot, by the adoption of a particular rule of liability or of procedure, exclude from its courts a suit on the judgment.
