Liebe Kollegen,

irgendwie bin ich mir nicht ganz sicher, ob "suspension" hier "Aussetzung des Vertrags" bedeutet. Aufhebung wäre ja wieder mit Auflösung bzw. Kündigung (cancellation) gleichbeteudend?

Carolin Haase: Und was bedeutet dann "totally cancel"? Heisst das nicht, dass der gesamte Vertrag ausser Kraft gesetzt wird?

-> Nein, meiner Meinung nach bedeutet "totally cancel", dass der Vertrag komplett (und endgültig) gekündigt wird. "Suspension" ist dagegen nur eine vorübergehende Aussetzung, keine Kündigung. Es bedeutet, dass eine Wiederinkraftsetzung möglich ist.

Ist auch nicht unbedingt das Gleiche, hängt von den Vertragsbestimmungen ab (grobe Vertragsverletzungen, Nichterfüllung, fristgerechte Kündigungen o. ä.)

Ergänzung zu deiner Ergänzung:

Da handelt es sich um eine Vetragsverletzung durch Nichterfüllung, würde ich sagen; infolgedessen kann der Käufer den Vertrag aufheben (oder evtl auch aussetzen, bis die Leistung erbracht wurde), wahrscheinlich mit sofortiger Wirkung.
