da es sich um eine rechtliche Festlegung handelt, würde ich es einfach mit "Nutzung" übersetzen. (denn für die Freude kann man wohl nicht so leicht Steuer verlangen).
use and enjoyment wird oft mit "Nutzung" in "terms and conditions" übersetzt:
