The new senior loan (the New Senior Loan) has each of the following characteristics:
(b) a principal balance that is no more than the original balance of the Senior Loan on the date of the refinancing plus any advances made by or on behalf of the original Senior Lender in order to protect or preserve the Properties or the Security Interests of the original Senior Loan Documents on the Properties; provided, however, that in connection with a refinancing in accordance with this Clause during the three (3) months prior to the Final Maturity Date, the principal balance may also include reasonable and customary CLOSING COSTS.
