Upon the occurrence of any Event of Default, except as otherwise provided in this Agreement, each party may pursue any right or remedy available at law or in equity including, without limitation, termination of this Agreement, and such equitable relief as may be necessary to enjoin any existing or threatened breach of any provision hereof, all of which shall be deemed cumulative and ***no one of which shall be deemed an election of remedies***
All diese Rechte und Rechtsmittel gelten als zusätzliche Rechte und Rechtsmittel - *und keines von ihnen gilt als Entscheidung für bestimmte Rechtsmittel*

Die Klausel soll ausdrücken, dass (anders als es unter den Regeln des common law ausgelegt werden könnte) die Benutzung eines der genannten Rechtsmittel nicht als entgültige, ausschließliche Festlegung auf solches Rechtsmittel gilt. Leider macht der englische Text das nicht völlig klar. Das Wort "Benutzung" ("exercise") fehlt. Es müßte heißen: "...and the exercise of no one remedy shall be deemed an election of remedies." Simply poor draftsmanship. This is pretty much a standard clause in many agreements. |
