Where leave is not granted to the Customer to withdraw from the litigation and for the Supplier to conduct the litigation in its own name, the Customer shall, upon the Supplier admitting its obligations under the indemnity referred to in clause XY, and where requested by the Customer, lodging security in a reasonable amount with the Customer, to the extent that it is permitted by law, defend, arbitrate, appeal, settle or otherwise conduct the litigation as the Supplier may from time to time reasonably direct. |
