Hallo Carmen, die Bedeutung hast du schon richtig erkannt. Ich würde der Klarheit halber wie oben mit zusätzlichem "ersatzweise" formulieren.
Ein Vertragspartner hat offenbar keine Gewährleistungsverpflichtung oder will diese nicht eingehen und kauft sich mit dieser Klausel von der Verpflichtung frei.

stimmt schon: Anstatt dass eine Garantiezusage gegeben wird, werden gleich Ersatzteile bzw. ganze Ersatzgeräte mitgeliefert.

Wird eine solche Beschaffenheits- oder Haltbarkeitsgarantie abgegeben, so ist § 443 Abs. 2 BGB anwendbar. Die Garantiezusage bezieht sich häufig auf die Funktionsfähigkeit bestimmter Teile (oder des gesamten Geräts) über einen bestimmten Zeitraum. Bei einer Garantie spielt der Zustand der Ware zum Zeitpunkt der Übergabe an den Kunden keine Rolle, da ja die Funktionsfähigkeit für den Zeitraum „garantiert“ wird.
