If the parties are unable to resolve any dispute as to the interpretation or carrying out of this Agreement within 90 days after the initial notice of the dispute by a party to the other party, any case, controversy, suit, action or proceeding arising out of, in connection with, or related to this Agreement shall only be *brought*, after the lapse of such 90-day period, *through litigation*.

Explanation:
Inhaltlich bin ich mir sicher; in der Formulierung gibt es sicher auch andere Möglichkeiten. Ich denke, es soll damit auch ausgedrückt werden, dass der Weg über ein "normales" Gericht geht und nicht etwa über ein Schiedsgericht, wie es ja zwischen Unternehmen auch häufig vereinbart wird.
