Aus einer Heiratsurkunde von 1997 aus Gambia.

In der 3. Spalte wird darunter das Alter der Eheschließenden angegeben. Ich verstehe hier "or married" nicht. Ich meine es kann ja sein, dass man in Gambia zur Zeichnung von Urkunden entweder volljährig oder verheiratet sein muss, aber bei einer Heiratsurkunde bietet sich das ja nicht an, wäre der Heiratswillige verheiratet, könnte er ja keine Ehe eingehen oder herrscht in Gambia "Vielweiberei".
Vielleicht bezieht sich Art.27 nur auf weibliche Personen: Bei Volljährigkeit dürfen sie selbst entscheiden. Bei Minderjährigkeit dürfen sie vielleicht verheiratet werden.
"full age or married" pertains to both women and/or men under certain circumstances that are not readily understandable to us outsiders.
Furthermore, people there probably marry at more or less any age they like and the certificate simply does not reflect actual practice, but rather a theoretical legal framework that few adhere to.
Problem is, women can marry, if they are not full age, right, but they cannot be married as only men are allowed to have several wives and not viceaversa. Men may have several wives, but may not be under age to marry. Therfore, how can anybody (man or woman) be either of full age or married? You must be of full age or already married to marry, but if you are not of full age you cannot marry at all? How, can you then be not of full age, but married, if you are not allowed to marry in the first place under age (as a man) and the married woman under age may not enter into another marriage, therefore it does not apply to women?
women do not necessarily need to be of "full age" to marry. So perhaps the entry "full age or married" simply reflects the realities of Ghanian society, i.e. the person is either of full age or already married, which for a man, would not rule his ability to enter into another marriage - but I'm really just guessing here.
Not the first marriage, but the "ongoing" marriage(s). Polygamy implies that the husband "adds" wives over time, so the certificate needs to reflect that fact. I mispoke about the certificate being for a man, obviously it is for both the husband and wife in question, though it is possible that the certificate might list several wives under certain circumstances.
I know that only men are allowed to have several wives, but in the marriage certificate its the heading in a table and no explicit difference is made between men and women. And I do not understand how the first marriage can be entered into, if one is not "full age", but I guess that's not my problem, as the translation bit is resolved.
because if polygamy is indeed legal in Gambia, only men would be allowed to have several wives, i.e. the notion of "already married" would be normal in a Gambian context, but obviously not here in the West.
I do not realyy understand your comment "if the certificate is for a man". It's a marriage certificate, it applies to both, man and woman celebrating marriage.
Andererseits sagt Artikel 27 der 1997 in Kraft getretenen Verfassung, dass jede volljährige und geschäftsfähige Person das Recht hat, zu heiraten...
Das muss aber wohl nicht bedeuten, dass Minderjähruge nicht heiraten können, denn zumindest bei Muslimen hält der Staat sich ganz aus familienrechtlichen Regelungen heraus und verweist auf die Scharia.
Jedenfalls dürfte der weltweit verbreitete Grundsatz herrschen, dass man auch vor Erreichen der Altersgrenze (Gambia meines Wissens früher 21, jetzt 18) durch Heirat die Volljährigkeit oder zumindest die volle Geschäftsfähigkeit erwerben kann. Das würde die Alternative "full age or married" erklären, weil full age hier wohl tatsächlich die Altersgrenze meint und nicht die "Volljährigkeit" (capacity).
Explanation: In Gambia ist Islam die Hauptreligion mit mehr als 90% Gläubigen und deshalb ist dort Polygamie erlaubt.
