Es geht um einen Treuhandvertrag bzw. um den Zusatz dazu, in dem die bisherigen Treuhänder ausscheiden und neue Treuhänder bestellt werden. Konkret geht ees nun um die Haftung der neuen in Bezug auf die alten Treuhänder, wobei folgender Satz vorkommt:
The new trustees covenant that they wil keep the retiring trustees fully indemnified provided always that the liability of the new trustees "may only be recovered by the retiring trustees out of the property subject to the trusts of the settlement".
Ich habe Schwierigkeiten mit dem Teil ab "may". Ich kann mir irgendwie keinen Reim darauf machen, wie dieses "recover" hier gemeint ist, sodass es im Zusammenhang mit der Haftung Sinn ergibt. |
