Die beiden Arten der Gewährleistung werden in Verträgen meist im Tandem aufgeführt: "express warranty" (also ausdrückliche/vertragliche Gewährleistung) und "implied warranty" (also stillschweigende/konkludente/gesetzliche Gewährleistung). Erstere muss im Vertrag ausdrücklich erwähnt werden, letztere ergibt sich aus der ausdrücklichen Gewährleistung und den jeweiligen gesetzlichen Umständen oder Bedingungen (daher konkludent). |
