oder:

Bin unsicher, wie ich hier certify verstehen soll. Als geprüft? Oder wurde die Angelegenheit an das höhere Gericht verwiesen? |

Eigentlich sieht es aus wie ein "Vorlagebeschluss", aber u.U. auf eigenen Beschluss statt auf Antrag einer der Parteien oder auf Beschluss eines anderen Gerichts (vgl. http://kansasstatutes.lesterama.org/Chapter_60/Article_32/ mit http://dejure.org/gesetze/GG/100.html ), d.h. es scheint so, dass das Gericht selbst eine Sache zur Entscheidung heranholen kann.

Here are some definitions from Black's Law Dictionary (8th ed. 2004):
"certification to state court, The procedure by which a federal court of appeals defers deciding a novel question of state law by certifying the question to the highest court of the state. See CERTIFICATION (5).
certification, n. 1. [...] 5. A procedure by which a federal appellate court asks the U.S. Supreme Court or the highest state court to review a question of law arising in a case pending before the appellate court and on which it needs guidance. Certification is commonly used with state courts, but the U.S. Supreme Court has steadily restricted the number of cases it reviews by certification. [...] Cf. CERTIORARI."
So, ja, ich würde schon sagen, dass es ist eine Art Vorlagenbeschlusses ist. :)

Wenn du meinst, dass es von dem niedrigeren Gericht ausgeht, dann würde ich als "dem höheren Gericht (zur Entscheidung der Rechtsfrage) vorlegen", also nicht "verweisen". Dir Juristen sprechen von einem so genannten "Vorlagebeschluss".
