Overview of **Intellectual Property** in Brazil
The Brazilian Patent and Trademark Office (“INPI”) is the governmental authority that grants patent, trademark and industrial design registrations. Trademark registrations under current law remain valid for a period of 10 (ten) years, and are renewable for equal successive periods. A patent remains valid for 20 (twenty) years, without possibility of renewal. Industrial design registrations last 10 (ten) years, and may be renewed for 3 (three) successive periods of 5 (five) years each.
Transfers of ownership and licenses of use of trademark, patent and design must be filed with the INPI. Any changes in the corporate name or principal place of business of the owner of these industrial properties must be reported to the INPI.
License agreements and any industrial property related agreements such as technology transfer and franchise agreements must be registered with the INPI in order to be enforceable against third parties, as well as for the remittance of royalties and tax deductibility purposes. |
