Under Brazilian law, tradenames are protected when the company’s articles of association or incorporation are registered with the Board of Trade. This protection will remain in force until the company ceases its activities or is liquidated.
The general understanding is that tradename protection is restricted to the State where the company was incorporated. However, some State courts have accepted that the company has the right to the exclusive use of the tradename within the entire Brazilian territory.
Trademarks are protected as from the date of application for registration. Any interested third party may oppose such application within the 60 (sixty) days term from the publication of the application in INPI’s Official Gazette. If no oppositions are presented, the INPI will start the **registration viability evaluation**.

Explanation:
Beim deutschen Patenterteilungsvefahren wird, wie die folgenden Seiten zeigen, auf "Patentfähigkeit" eprüft, bevor das Patent erteilt wird. Das Patent muß u.a. die Voraussetzung der "gewerblichen Anwendungsfähigkeit" erfüllen. Diese wird im Englsichen, wie auf der zweiten Site gezeigt, mit "commercial viability" bezeichnet. Bin mir hier aber nicht ganz sicher, ob in Deinem Zusammenhang allgemein auf die Patentfähigkeit ode konkret auf die besagte gewerbliche Anwendbarkeit geprüft wird.

Should All Inventions Be Patented?
Sometimes, given the cost and complexity of the patent process, it is not beneficial to obtain a patent. If there is a very limited market for an item, or where it is likely that the viability of the patent would be challenged, a careful market analysis is warranted before incurring the expense associated with the patent process.

Gewerbliche Anwendbarkeit
Nach § 5 liegt das Merkmal der gewerblichen Anwendbarkeit vor, wenn ihr Gegenstand auf irgend einem gewerblichen Gebiet einschließlich der Landwirtschaft hergestellt oder benutzt werden kann. Bereits nach der gesetzlichen Fassung wird das Merkmal mithin weit ausgelegt. Nicht umfasst sich allerdings die (nichtgewerblichen) sog. freien Berufe.

Patentfähigkeit ist die Voraussetzung für die Erteilung eines Patents. Sie liegt vor, wenn die Erfindung, für die das Patent ereilt werden soll, neu ist, auf einer erfinderischen Tätigkeit beruht und gewerblich anwendbar ist. Vgl. §§ 1 bis 5 Patentgesetz
