The Software Law establishes the following penalties for software copyright violation:

(i) infringement of software copyright: detention from 6 (six) months to 2 (two) years or a fine;

(ii) if the software copyright infringement consists in counterfeiting the software by any means, without the prior and express authorization of the software owner or its representative for commercial purposes: imprisonment from 1 (one) to 4 (four) years plus a fine;

(iii) the person who sells, makes available to be sold, brings into the country, acquires, hides or stores, for commercial purposes, the original or a copy of a software the manufacturing of which has infringed a third party’s software copyright is also subject to the same penalty listed in item (ii).

In Brazil, criminal responsibility of a company falls upon its legal representatives acting on behalf of the company at the moment of the crime.

Moreover, in case of software infringement, the owner is entitled to provisional remedies to seize the hardware, especially personal computers (PCs) as well as claim loss and damages from the infringing party. The **statutory bar** (statute of limitations) to demand loss and damages in copyright infringement matters is 5 (five) years.

Ich denke, der Satz sollte wohl eher so etwas wie "Claims for loss and damages in copyright infringement are 'statute-barred' after five years." heißen. D.h. es geht nicht um die Verhinderung der Ansprüche vor Ablauf der 5 Jahre, sondern danach.

Okay, das war nicht sehr juristisch formuliert: \"um die Verhinderung der Geltendmachung ...\" wäre besser.

Ich sehe den Ausdruck \"to demand\" aus dem Text als eine Umschreibung für \"to bring a claim\".

Ich denke, der Satz sollte wohl eher so etwas wie "Claims for loss and damages in copyright infringement are 'statute-barred' after five years." heißen. D.h. es geht nicht um die Verhinderung der Ansprüche vor Ablauf der 5 Jahre, sondern danach.

agree  Hans G. Liepert: Die Verjährungsfrist für Ansprüche .... beträgt fünf Jahre (Verhinderung der Geltendmachung ist nicht besser, sondern schlechtes Deutsch)
