English term or phrase: opinion letter
The program we propose is one where a German (for the sake of your opinion letter) would immigrate to ABC and, in the process of immigrating, would put some or all of his assets into an offshore trust.

I have found a definition of opinion letter, according to which it is also called an 'advisory letter'. Would it be safe to translate it as Rechtsgutachten?

I think it should be safe to translate "opinion letter" in your context as "Rechtsgutachten". You may also say "rechtliche Stellungnahme".

This English term can also refer to some type of official legal opinion of a government authority - which may be properly translated as "offizielle Rechtsansicht" or "Rechtsauskunft" (...einer bestimmten Behörde). Or it can refer to a "Rechtsgutachten" of an attorney on a specific issue - his/her legal opinion based on a specific set of facts.

If your context does not involve any governmental authority, I would probably go with "Rechtsgutachten" - as a general term.

Ich kann nur zustimmen. Das ist hier eindeutig ein "Rechtsgutachten" bzw. allgemeiner eine "Rechtsmeinung".

Zur Abgrenzung der vorgeschlagenen Begriffe:

1. opinion letter

Def.: "A formal expression of judgment or advice based on an expert's special knowledge; esp., a document usu. prepared at a client's request, containing a lawyer's understanding of the law that applies to a particular case" (Black's Law Dictionary)

2. advisory opinion

Hiervon ist die "advisory opinion" abzugrenzen: "A nonbinding statement by a court of its interpretation of the law on a matter submitted for that purpose" (vgl. ebenda).

Besser noch diese Definition: "an opinion by a court on a hypothetical legal question (...), as distinguished from a question arising in an actual case" (Dict. of the law)

Der Unterschied liegt darin, dass es sich bei einer "advisory opinion" um ein "gerichtliches (Rechts)gutachten" handelt, das von einem "legislative or executive body" begehrt wird (z.B. zur Frage der Verfassungsmässigkeit eines Gesetzentwurfs usw.).

Ein "opion letter" ist das "Rechtsgutachten" eines Anwalts, das vor dem Hintergrund eines konkreten Sachverhalts zur Abklärung einer bestimmten Rechtsfrage in Auftrag gegeben wird.
