In einem Vertrag steht unter dem Punkt "Haftungsbeschränkung" der folgende Satz: "Except for liabilities arising under Clause x hereof (Indemnification) in the case of third party claims, to the fullest extent not prohibited by applicable law, the liability of either Party for any breach of this Agreement, or arising in any other way out of the subject-matter of this Agreement, will not extend to loss of business or profit, or to any indirect or consequential damages or losses"

Ich bin mir nun nicht sicher, ob sich die third party claims auf den ersten Satzteil "except for liabilities arising under xx in the case of third party claims" beziehen oder auf den zweiten Satzteil " exept for..., in the case of third party claims... the liabilitiy will not extend".

In dem zitierten Punkt Indemnification steht übrigens, dass die jeweils andere Partei für alle Ansprüche aus Vertragsverletzung o.ä. freizustellen hat, unabhängig davon, ob Drittansprüche involviert sind oder nicht.
