Greatest care should be taken in the creation of new documents so as to avoid creating potentially damaging material that will not *attract privilege and that will be discoverable in due course*.

Der ungefähre Sinn ist mir klar: Sein Mandant soll keinen weiteren Schaden anrichten, indem er neue Dokumente ausfertigt, um der Gegenseite nicht in die Hände zu spielen, aber as meint er genau mit dem letzten Teil?
