s. u. -------------------------------------------------- Note added at 1 hr (2007-04-05 10:38:10 GMT) -------------------------------------------------- Evidence in chief – The evidence which a witness gives in response to examination on behalf of the party who has brought the person forward as a witness (see examination in chief). Once evidence in chief has been completed, the witness is normally made available for cross-examination by the other party or parties to the proceedings. Under the Youth Justice and Criminal Evidence Act 1999 it is possible for a video recording to be used as a witness’s evidence in chief even where he or she is not available for cross-examination, provided that the parties to the proceedings have agreed that cross-examination is not necessary or where a Special Measures direction provides for the witness’s evidence on cross-examination to be given otherwise than by testimony in court. http://www.cps.gov.uk/publications/prosecution/bestevidencev... |
