Falls er als "unreasonable" gilt... "the whole claim for costs shall then be subject to a detailed assessment on an indemnity basis in accordance with CPR Part 48.8.
Ich habe die folgende Erklärung gefunden, bin mir aber nicht sicher wie ich "indemnity basis" hier verstehen soll.
Assessment on an indemnity basis is construed at Order 48A rule 12(2) in the following terms:
“(2) On an assessment on the indemnity basis all costs shall be allowed except insofar as they are of an unreasonable amount or have been unreasonably incurred and any doubts which the Chief Registrar may have as to whether the costs were reasonably incurred or were reasonable in amount shall be resolved in favour of the receiving party; and in these rules the term 'the indemnity basis' in relation to the assessment of costs shall be construed accordingly.” |
