English term or phrase: equitable nature

In einem Scheidungsurteil komme ich mit folgendem Satz bzw. Teil nicht zurecht:

"...the Court being satisfied that the Property Settlement Agreement with all the terms and conditions thereein were arrived at knowledgeably, voluntarily and with the advice of counsel and with the intention of both parties to be bound thereby, but the Court not making any finding as to the "equitable nature" thereof....

Ich bin mir nicht sicher, ob das "Billigkeit" heissen kann. Andererseits verstehe ich dann das "but the Court" nicht. Die Vereinbarung (Property Settlement Agreement) wurde doch in beiderseitigem Einvernehmen beider Parteien geschlossen, wie kann das Gericht dann dessen Billigkeit nicht feststellen?

Vielleicht kann mir einer meinen Knoten im Gehirn lösen...?;-)

Explanation:
Wenn man im IATE unter "equitable" nachschaut, so wird in der Mehrzahl der Treffer "equitable" mit "angemessen" übersetzt, während für "billig" eher "fair" genommen wird.
