Explanation: Ich stelle die Antwort hier nochmals ein, damit Du sie eventuell doch noch bewerten kannst :-) Meine Patentkunden bestehen auf der dem Wortlaut entsprechenden Übersetzung: Die vorliegende Patentanmeldung beansprucht den Vorteil der vorläufigen US-amerikanischen Patentanmeldung Nr. 123... Allerdings hat bambam damit Recht, dass diese "Provisional Application" eine US-spezifische Anmeldeform ist. Aber wie schon gesagt: Ich habe eine Reihe von Patentkunden, und die wollen ausdrücklich obige Lösung, ohne Deutungsversuche oder Anpassungen auf eventuelle duetsche Gepflogenheiten |

Explanation: wie oben zu Thilo: Das könnte Redundant sein, allerdings könnte der "claim of benefit" einer Provisional Application auch sowas sein wie unsere Nachanmeldung oder die Zusatzanmeldung. Dann wäre das was anderes. Aber ich bin im amerikanischen Patentrecht nicht fit. Danke natürlich für die Punkte ;-)) -------------------------------------------------- Note added at 2 hrs (2007-09-03 11:33:14 GMT) -------------------------------------------------- Hallo Thilo, habe mich gerade schlau gemacht: "claim the benefit" ist eine Prio-Inanspruchnahme (innere US-Prio, Nachanmeldung), während "incorporated by reference" lediglich die Offenbarung eines Patents betrifft, z.B. auch ein Patent Dritter sein kann. Ob man allerdings "beansprucht die Priorität der US xyz" sagen, kann ich Dir nicht pauschal beantworten. Aber wenn Dein Mandant damit einverstanden ist... mE wäre diese Formulierung bei diesem Sachverhalt zumindest nicht falsch und ich würde es ggf. damit probieren. Gruß bambam |
