als Möglichkeit, auch dem zweiten Satz gerecht zu werden, sonst üwrde es heissen "bei der Eigentumsübertragung wird der Verkäufer das Eigentum auf den Käufer übertragen", was wohl nicht gut wäre.
Ausserdem wäre die Auflassung als "dinglicher Vertrag", bei dem erst das Eigentum am Grundstück übertragen wird und der vom Kaufvertrag als "schuldrechtlicher Vertrag" abzugrenzen ist, eine brauchbare Parallele des deutschen Rechts zur amerikanischen Unterscheidung zwischen "contract of purchase" und "closing of title". Leider kann ich das hier alles nur auf deutsch erläutern. Eine Definition von "closing of title": "The Closing of Title means that the property will change hands to the new owner and that the deal is considered closed" vgl. Referenz, "title" ist hier also kein Dokument, sondern das Recht selbst.
Fürs Glossar ist mein Vorschlag vielleicht nicht geeignet, er soll eher die Formulierung der zu übersetzenden Sätze erleichtern.

Danke für die Punkte. Im Nachhinein kamen mir wieder Zweifel, weil \"Auflassung\" sonst auch als \"conveyance\" übersetzt wird, dementsprechend wird im Zusammenhang mit derm \"closing of title\" eine \"deed of conveyance\" ausgestellt.
Der Problematik, amerikanische juristische Ausdrücke mit Ausdrücken aus dem anders funktionierenden deutschen Recht zu \"übersetzen\", entkommt man bei solchen Sätzen wohl nicht. |
