As in case DE/2006/0343, the BNetzA states that under German law, the BNetzA is not in the position to impose ex ante price regulations for operators that would not fulfill the ***“double dominance” test*** (According to this test, ex ante price control can only be imposed on operators that (i) are dominant both on retail and wholesale level and (ii) were designated with SMP status under the previous telecommunications regime).
