"factory shortage" gibt im Google zahlreiche Treffer, woraus m.E. zu ersehen ist, dass der Begriff vieles bedeuten kann:
Es gibt zu wenig Fertigungsbetriebe
Das Werk kann nicht liefern
Das Werk hat zu wenig gleliefert (Minderlieferung)

Explanation:
Wieso hier nicht Engpass benutzen?

Forderungen/Ansprüche, die aus einem Engpass (in der Produktion) resultieren/entstehen, werden nicht geltend gemacht / können nicht geltend gemacht werden, es sei denn...

Da es sich hier um den Hersteller selbst handelt, würde ich eventuell das "Liefer-" auslassen. Es wäre aber auch nicht falsch, Lieferengpass zu schreiben, da sie zuerst nicht produzieren und folglich nicht liefern können.

neutral  Rolf Kern: Bitte den Satz genau lesen. Es ist doch nicht denkbar, dass ich dem Lieferanten gegenüber einen Lieferengpass geltend machen kann, wenn dies innerhalb von 10 Tagen nach Emfang (!) der Ware geschieht.

  -> Empfang der Teilmenge, die bereits geliefert wurde. Wo ist da genau der Unterschied zur Minderlieferung? Die besagt doch auch, dass nicht alles geliefert werden kann?
