Μια μικρή βοήθεια σε μια πρόταση όπου δε μπορώ να βγάλω νόημα. Πρόκειται να απολυθεί ένας υπάλληλος λόγω παραβίασης των κανόνων ασφαλείας της επιχείρησης και, λόγω των δυσκολιών που θα αντιμετωπίσει στην ανεύρεση νέας εργασίας θα του δώσουν καλές συστάσεις και "a generous payment in lieu of notice"

Στις 22 Μαΐου 1992 ο Dassy ενήγαγε, ενώπιον του tribunal du travail de Huy, τη Sovam και την Dethier ζητώντας να υποχρεωθούν εις ολόκληρον να καταβάλουν τα ποσά τα οποία του οφείλονταν ως αποζημίωση λόγω καταγγελίας της συμβάσεως εργασίας, ως άδειες μετ\' αποδοχών και ως πριμοδοτήσεις κατά το τέλος του έτους. Ισχυρίστηκε ότι η μεταβίβαση της επιχειρήσεως ήταν συμβατική και ότι η Dethier ευθυνόταν, επομένως, εις ολόκληρον για την καταβολή αυτή.

3. Σε περίπτωση πρόωρης καταγγελίας σύμβασης εργασίας ορισμένου χρόνου, οφείλεται αποζημίωση στον εργαζόμενο ίση με τους μηνιαίους μισθούς που ακολουθούν μέχρι τη συμφωνημένη συμβατική λύση της εργασιακής του σχέσης.
4. Σε περίπτωση καταγγελίας σύμβασης εργασίας αορίστου χρόνου οι υπάλληλοι δικαιούνται αποζημίωσης ανάλογα με το χρόνο εργασίας τους και εφόσον έχουν συμπληρώσει τουλάχιστον δίμηνη απασχόληση στον ίδιο εργοδότη.

Nadia-Anastasia Fahmi: Kαμιά φορά δεν πρέπει να κολλάμε στις λέξεις... Σε αυτή την περίπτωση, συμφωνείτε ένα ποσό (αρκετά σεβαστό) και δεν γίνεται καταγγελία της σύμβασης εργασίας (απόλυση), αλλά εμφανίζεται ως οικειοθελής αποχώρηση, για να μπορεί να βρει εργασία ο υπάλληλος.

Εάν η καταγγελία είναι νόμιμη, η εργασιακή σχέση λήγει. Για να είναι νόμιμη και έγκυρη στην περίπτωση καταγγελίας σύμβασης αορίστου χρόνου από εργοδότη, πρέπει αυτή: i) να είναι γραπτή και ii) να καταβάλλεται αποζημίωση. Είναι επίσης δυνατή η καταγγελία με προμήνυση (τακτική καταγγελία). Ο χρόνος προμήνυσης καθορίζεται με βάση τα χρόνια προϋπηρεσίας του μισθωτού. Η εργασιακή σχέση πρέπει να έχει διαρκέσει τουλάχιστον 2 μήνες. Χωρίς προμήνυση η καταγγελία ονομάζεται άτακτη, καταβάλλεται δε αποζημίωση ανάλογη με το χρόνο προμήνυσης (δηλαδή ίση με τους χρόνους προμήνυσης). Αποζημίωση καταβάλλεται και στην περίπτωση τακτικής καταγγελίας, είναι όμως η μισή απ’ όση θα καταβάλετο επί άτακτης καταγγελίας.

Πότε οφείλεται μειωμένη αποζημίωση; Η απόλυση των υπαλλήλων μπορεί να γίνει μόνο κατόπιν έγγραφης προειδοποίησης πριν από ορισμένο χρόνο, που είναι ανάλογος με τα χρόνια υπηρεσίας του στον εργοδότη.
Η προειδοποίηση αυτή ονομάζεται προμήνυση. Ο χρόνος της προμήνυσης φαίνεται στους πίνακες αποζημίωσης που υπάρχουν παρακάτω. Στην περίπτωση αυτή ο μισθωτός παραμένει στην εργασία του μέχρι να λήξει ο χρόνος προμήνυσης και κατά την απόλυση του καταβάλλεται το 1/2 της νόμιμης αποζημίωσης.

-> Το "in lieu of notice" είναι "αντί προμηνύσεως". Το εάν χρησιμοποιείται από κάποιον καταχρηστικά αποτελεί ερμηνευτικό σχόλιο, όχι εγγραφή για γλωσσάρι. Εγώ κομίζω τον όρο προμήνυση.

Explanation:
Λογικά με βάση το συμβόλαιό του, θα πρέπει να τον ειδοποίησουν ένα συγκεκριμένο χρονικό διάστημα πριν να τον απολύσουν. Επειδή θέλουν να τον απολύσουν αμέσως, τον αποζημιώνουν ώστε να μη χρειαστεί να περιμένουν το διάστημα που θα έπρεπε κανονικά.

Payment in lieu of notice clauses

You either have one in your contract or you do not - the law will not imply one into the contract.

So what are they and how do they affect you ? - This article explains it all!

Every employee is entitled to notice of dismissal unless he or she is guilty of gross misconduct.

If a company wants an employee to leave, it has a number of choices:
it can ask him or her to work during the notice period - all payments are fully taxed;
it can sack immediately and pay damages for breach of contract in not giving notice. The amount of damages is the amount of money the employee would have received in his or her hand had he or she worked during the notice. In other words, it is the net amount. Many companies, however, pay the gross amount of notice money thinking that because genuine damages for breach of contract can be tax free the employee should get the gross amount. In fact, this is wrong but we can explain how to use this to your advantage and get more money than you are entitled to;
it can make a payment in lieu of notice if it has the power, even a discretionary power, to do so in the contract. If it does make a payment in lieu of notice in this way, the whole payment is taxed.
It can negotiate before terminating. The Inland Revenue take the view that a negotiated payment in this way without any breach of contract is taxable. We can advise if this can be avoided.

Nadia-Anastasia Fahmi: Διαφωνώ Αλέξανδρε. Είναι οικονομική συμφωνία και γίνεται για να μην υπάρχει καταγεγραμμένη απόλυση σε βάρος του υπαλλήλου και να μπορεί να βρει νέα εργασία πιο εύκολα.
