LEASING OF PREMISES
INSTRUCTIONS FOR USING DRAFT LEASE —
The following instructions deal with the substance and formalities of leasing and are to be read in conjunction with other instructions regarding financial procedures, engagements of local lawyers, etc.
This lease template is to be used only for residential accommodation. It represents an ideal situation from the Government’s viewpoint but is nonetheless fair and balanced. It may not be acceptable in all respects to all prospective lessors. However, the terms and conditions should be adhered to wherever possible.
If the Lessor requires any changes in or additions to the draft lease, care should be taken to ensure that they do not result in restrictions which might interfere with the Mission’s security, or unduly compromise the Government’s position.
Where any portion of the rent ***is to be borne by the Government***, all leases should be taken in the name of ‘The Commonwealth of Australia’ and not in the name of the post or of an individual. Where private leases are taken out, the lease should be in the name of the individual officer and will replace the words ‘The Commonwealth of Australia’.
