Dear Ellen,
Thank you indeed for all the interesting information you have provided us. I do share your irritation about the predominant occurrence of american sources on the PCA issue. As for the right to appeal against a PCA, I can only refer to the Greek and French legislation. In both countries, a PCA can be appealed a part from the equivalent of the British Final Court of Appeal, named " Cour de cassation " in France et '' Αρειος Πάγος '', in Greece. There are two other authorities, in both countries, whose PCAs can not be appealed : le Conseil Constitutionnel, in France, and its Greek equivalent Το Συμβούλιο της Επικρατείας. You certainly know their specific jurisdiction, particularly aiming the control of a law's or a decree's accordance with the national constitution.
Καλό βράδυ κι ευχαριστώ πολύ.
what I find irritating is the fact that literature on PCAs was predominantly from sources related to the Floridian appellate courts: As Chair of your Committee on Per Curiam Affirmed Decisions, I submit to you the .... District Courts of Appeal and the Florida Supreme Court can afford not to be ...... Those judgments are also appealed and decided by another PCA. ...

Looking further into the matter I would like to point out that the exact term is PCA (per curiam affirmed). A criticism of PCAs is that such a decision and the lack of a record for its basis opens further review. I furthermore found out that it is possible to appeal per curiam decisions which are not more or less valid than decisions signed by judges. They can indicate a unanimous decision on the part of the court, but this is not necessarily the case. Like other legal judgments, they can potentially be appealed if someone feels that the judgment was reached in error or that there were problems in the court which might have impeded justice, such as incomplete information or evidence tampering. What I could not find out, however, is whether PCAs may equally be appealed or not.
Dear Ellen, καλημέρα !
I have carefully read your discussion entry. You are pointing out a really important issue about the jurisdictional value of a per curiam opinion : is it a real judgement or just an opinion ?
I will carry on my research and I will keep you informed.
Ευχαριστώ γιά τον διάλογο και καλό απόγευμα !
In view of the following link, I dont think the term in question is idential with an < απόφαση με ισχύ δεδικασμένου > In law, a per curiam decision (or opinion) is a ruling issued by an appellate court of multiple judges in which the decision rendered is made by the court (or at least, a majority of the court) acting collectively and anonymously.[1] In contrast to regular opinions, a per curiam does not list the individual judge responsible for authoring the decision,[1] but minority dissenting and concurring decisions are signed.[2]
Per curiams are not the only type of decision that can reflect the opinion of the court. Other types of decisions can also reflect the opinion of the entire court, such as unanimous decisions, in which the opinion of the court is expressed with an author listed.[3] The Latin term per curiam literally means "through the court".
Κατ'αρχήν, ζητώ συγγνώμη από την Ιωάννα γιατί είχε ήδη δημοιεύσει την πρώτη από τις δύο αναφορές μου.
Θα μπορούσε η ερωτώσα συνάδελφος να μάς διευκρινίση εάν πρόκειται όντως περί δικαστικής γνωματεύσεως ;
Ευχαριστώ εκ τών προτέρων !

Per curiam refers to a decision handed down by the court as a whole, without identifying any particular judge as the author. It is the opinion of the court as a single body. Most decisions on the merits by the Supreme Court and other appellate courts in the U.S. are signed by individual justices. Even when such signed opinions are unanimous, they are not termed "per curiam." Per curiam decisions usually deal with issues the court views as relatively non-controversial.
For example, "per curiam affirmed" (PCA) refers to a decison of a court, without identifying any judges by name, finding that the decision of a lower court was correct. Such a decision is often made without rendering an opinion. This may be due to the heavy caseload of a court and need to conserve scarce judicial resources, which prevents a written opinion in every case. A criticism of PCA's is that such a decision and the lack of a record for its basis recludes further review.
Reference information: The following abstract proves that the "par curiam" term doesn't refer to a simple court's advice or opinion but to a real and official judgement ! The difference, compared to other judgement forms, is that a per curiam judgement has a collegiate character.

2. " A "per curiam" decision is a decision delivered via an opinion issued in the name of the Court rather than specific judges. Most decisions on the merits by the Supreme Court (and other appellate courts in the U.S.) take the form of one or more opinions signed by individual justices (and joined in by others). Even when such signed opinions are unanimous, they are not termed "per curiam." "Per curiam" decisions are given that label by the Court itself and tend to be short. Usually, though not always, they deal with issues the Court views as relatively non-controversial. "
