When litigation takes place, or appears likely, between the firm or a member of the assurance team and the assurance client, a self-interest or intimidation threat may be created. The relationship between client management and the members of the assurance team must be characterised by complete candour and full disclosure regarding all aspects of a client's business operations. The firm and the client's management may be placed in adversarial positions by litigation, affecting management's willingness to make complete disclosures and the firm may face a self-interest threat. The significance of the threat created will depend upon such factors as:
the materiality of the litigation
the nature of the assurance engagement
whether the litigation relates to a prior assurance engagement.
Once the significance of the threat has been evaluated the following safeguards should be applied, if necessary, to reduce the threats to an acceptable level:

Threatened litigation poses a different challenge since the only way to determine the LIKELIHOOD of such litigation happening is from other aspect of the due diligence review such as fulfillment or material contracts, compliance with laws and relationship between the Target and its personnel.
A kilátásba helyezni viszont azt jelenti, hogy valaki már kijelentette.
Kilátásba helyezem, hogy holnap narancslevet iszom, azaz én közlöm, hogy lehetséges, hogy narancslevet fogok inni. Viszont a threatened esetében itt nem közlik, csak a másik fél ráutaló magatartásából lehet gondolni. Ezért esetleges.
