Egy oldalon ezt találtam: "az angol-szász jogban a „theory of estoppel” elvében fejeződik ki (a jog valakit korábbi cselekvése vagy nem cselekvése miatt megakadályoz abban, hogy valamely tényt állítson vagy tagadjon)."
Valahol máshol a "kizárás" szó szerepelt magyarázatként. Ha viszont simán "kizárásként" fordítom, félő, hogy a magyar sokkal általánosabb lesz, mint a forrásszöveg.
Van valakinek szép megoldása erre?

A személyeknek létezik egy vélelmezett akarata, amely tevőleges vagy nem tevőleges cselekedetben nyilvánul meg, és a jog a már kifejezetten vagy hallgatólagosan (amikor nem tagadnak egy tényt) kinyilvánított álláspontuk megváltoztatásában akadályozza meg őket.
Egyébként még az egyetemen is az estoppel elvét tanítják. Nincs még rá pontos magyar megfelelő, csak körülírás.
Oxford Dictionary of Law: "A rule of evidence or a rule of law that prevents a person from denying the truth of a statement he has made or from denying fact that he has alleged to exist. The denial must have been acted upon (probably to his disadvantage) by the person who wishes to take advantage of the estoppel or his position must have been altered as a result." |
