La frase va ricomposta così:
Confidential information shall be and remain the property of the Disclosing Party as between the parties.
E' un tipico caso in cui l'inglese giuridico tende a specificare al massimo. Come scrive nel suo bell'articolo sulla traduzione giuridica D. Pirro: "il tentativo di ottenere una estrema precisione attraverso il frequente uso di endiadi (es. «all sums of money accounts claims and demands») o di specifiche esclusioni (es. «and no other purpose»)."
In altri termini, qui il testo vuole precisare senza possibilità di equivoci che le informazioni riservate resteranno di proprietà del "disclosing party" in generale e anche in particolare per quanto concerne le parti in oggetto.
