Tradurrei così:
"In forza di quanto sopra descritto, posto che il Convenuto era vincolato a un obbligo di diligenza nei confronti dell'Attrice, e avendo egli omesso di profondere i propri sforzi e la propria cura ai fini di informarla, rinunciando a impiegare la diligenza necessaria a garantire che i prodotti forniti e/o le istruzioni impartite all'Attrice evitassero di produrle lesioni..."
Mi pare che la frase "the first-named Defendant owed the Plaintiff a duty of care " possa considerarsi come una proposizione incidentale, compiuta in sé e dal sapore tendenzialmente causale. Occorre immaginare una virgola subito dopo la stessa mentre è bene aggiungere una voce verbale al gerundio (being) all'inizio di quella successiva, anch'essa dal valore causale, che si apre con "in negligence" e il cui soggetto continua ad essere il Convenuto.
