Law/Patents - Law: Contract(s) | | English term or phrase: Indemnity against breach | This is a typical contact provision in Tenancy agreement, however, I'm not sure the exact meaning of the word "indemnity" in this provision. It seems it may be translated as "release of liability" in a broader sense or "reimbursement for actual loss" in a narrower sense.
And when it comes to the practical sense, its the translation really affects the rights and responsibilities of both Landlord and Tenant.
Below is the context. Please, provide your clarification on this. Thank you in advance.
Tenant's obligation:
To keep the Landlord indemnified from and against all actions, claims, losses, damages and expenses arising from any breach, non-observance or non-performance of any of the agreements or covenants on the part of the Tenant herein contained or from the use of the Premises or the electrical or gas installation or apparatus therein or out of any works carried out at any time during the term to the Premises or out of anything now or during the term attached to or projecting from the Premises or arising from any act, neglect or default of the Tenant. |
